محتواه في التالي: (أ) لأي غرض غير مشروع؛ (ب) لحث آخرين على القيام أو المشاركة في أي أعمال غير مشروعة؛ (ت) لتخرق أي انظمة أو قواعد أو قوانين دولية أو فدرالية أو خاصة بمقاطعة/اقليم أو متعلقة بالدولة أو القوانين المحلية؛ (ث) ان تخل أو تمس بحقوق الملكية الفكرية الخاصة بنا أو حقوق الملكية الفكرية الخاصة بآخرين (ج) أن تزعج أو تسيء أو تشتم أو تؤذي أو تشهر أو تلجأ للقذف الشفهي أو ان تنال من اعتبار/مكانة أو ان تخيف أو تعمل على التمييز المؤسس على التوجه الجنسي أو الدين أو الرابطة العرقية/الأثنية أو العرق أو السن أو الأصلالقومي أو العجز الجسدي/ العقلي؛ (ح) تقديم معلومات كاذبة ومضللة؛ (خ) ارسال أو نقل فيروسات أو أي نوع آخر من الرمز الخبيث والتي ستستخدم أو يمكن ان تستخدم بأي طريقة من شأنها التأثير على عمل أو تشغيل الخدمة أو أي موقع الكتروني ذو صلة أو مواقع الكترونية أخرى أو الإنترنت؛ (د) ان تجمع أو تتبع المعلومات الشخصية لآخرين؛ (ذ) ان ترسل ما لا جدوى له أو تحتال الكترونياً أو ---؟-- أو تتذرع ب أو تقوم بأعمال لا تمت للواقع بصلة أو توبخ بعنف أو تكشط؛ (ر) لأي غرض فاحش أو غير أخلاقي؛ أو (ز) أن تتدخل مع أو تتحايل على ميزات الأمان للخدمة أو أي مواقع الكترونية ذات صلة أو مواقع الكترونية اخرى أو الإنترنت. نحن نحتفظ بالحق في انهاء استخدامك للخدمة أو أي موقع الكتروني ذو صلة لخرق أي من الاستخدامات المحظورة.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
انت توافق صراحة على أن استخدامك أو عدم تمكنك من استخدام الخدمة هو على مسؤوليتك الخاصة. ان الخدمة وكافة المنتجات والخدمات المرسلة اليك من خلال الخدمة (باستثناء ما هو مذكور صراحة من قبلنا) مقدمة "كما هي" و "كما هي متوافرة" لاستخدامك، بدون أي تصريحات علنية أو ضمانات أو شروط من أي نوع كانت، سواء صراحة أو ضمنياً، مشتملة كافة الضمانات غير المعلن عنها أو الشروط الخاصة بالتسويق وجودة التسويق ومناسبتها لغرض محدد والمتانة والملكية وعدم التعدي.
Perksly and/or Cairo Amman Bank are not liable for the loss of points allocated/collected before the expiration date should the service become indefinitely inactive or expired for any reason being.

In no case shall Perksly and/or Cairo Amman Bank, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
تحت أي ظرف، لا تكون بيركسلي Perksly و/أو بنك القاهرة عمان، او من هو تابع لنا من مدراء أو مسؤولين أو موظفين أو شركات فرعية أو وكلاء أو مقاولين أو متدربين أو مزودين أو مقدمي الخدمة أو مرخصين مسؤولين عن أي اصابة أو خسارة أو مطالبة أو أي اضرار مباشرة أو غير مباشرة أو طارئة أو تأديبية أو خاصة أو خطيرة من أي نوع كانت، بما في ذلك وليس حصرياً، الكسب الفائت أو خسارة الإيراد أو خسارة المدخرات أو فقدان البيانات أو تكاليف الإحلال أو أي خسائر مشابهة، سواء قائمة على اساس العقد أو الخطأ (متضمنة الإهمال) أو المسؤولية المشددة أو من نواح أخرى، ناشئة عن استخدامك لأي خدمة أو اي منتجات تم الحصول عليها من استخدام الخدمة، أو عن أي مطالبة اخرى تتعلق بأي طريقة باستخدامك للخدمة أو أي منتج، بما في ذلك وليس حصرياً، أية اخطاء أو اوجه اهمال في أي محتوى، أو أي خسارة أو ضرر من أي نوع كان مترتبة كنتيجة لاستخدام الخدمة أو اي محتوى (أو منتج) تم نشره أو نقله أو تم اتاحته بطريقة اخرى عبر الخدمة، حتى لو تم الإفادة عن امكانيتهم. لأن بعض الدول أو جهات الاختصاص القضائي لا تسمح باستبعاد أو تحديد المسؤولية عن الأضرار الخطيرة أو الطارئة، في تلك الدول أو جهات الاختصاص القضائي، تكون مسؤوليتنا محصورة بالحد الأقصى المسموح به بموجب القانون.
You agree to indemnify, defend and hold harmless Perksly and Cairo Amman Bank and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
انت توافق على أن تعوض وتدافع عن وعدم الحاق الأذى والضرر ببيركسلي Perksly و/او بنك القاهرة عمان وبكل من هو تابع لنا من الشركات الأم والشركات الفرعية والشركاء والمسؤولين والمدراء والوكلاء والمقاولين والمرخصين ومزودي الخدمة والمقاولين من الباطن والمزودين والشركات الداخلية والموظفين، وذلك من أي مطالبة أو طلب متضمنة أتعاب المحاماة المعقولة، مقدمة من قبل أي طرف ثالث نسبة الى أو ناشئة عن اخلالك بهذه الشروط للخدمة أو المستندات التي تتضمنها بالإشارة اليها أو ان تلجأ الى خرق أي قانون أو المساس بالحقوق الخاصة بطرف ثالث.
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
في الحالة التي يتقرر فيها اعتبار أي حكم من هذه الشروط للخدمة غير قانوني أو لاغٍ أو غير نافذ، رغم ذلك يكون ذلك الحكم واجب النفاذ الى أقصى حد يسمح به القانون المعمول به، ويكون الجزء غير النافذ منفصلاً عن هذه الشروط للخدمة، لا يؤثر ذلك القرار على صحة ونفاذ أي من الإحكام الأخرى المتبقية.
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
ان واجبات والتزامات الأطراف المترتبة قبل تاريخ الانتهاء لا تتأثر بانتهاء هذه الاتفاقية لكافة الأغراض.

إذا تبين بمحض تقديرنا بانك تخفق أو كنا نميل الى الاعتقاد بانك قد اخفقت بالعمل بموجب أي شرط أو حكم من هذه الشروط للخدمة، يجوز لنا ايضاً إنهاء هذه الاتفاقية في أي وقت دون توجيه اشعار، وستبقى ملتزماً بكافة المبالغ المستحقة لتاريخه وبما في ذلك تاريخ الإنهاء؛ و/أو وفقاً لذلك، يجوز حرمانك من الوصول الى خدماتنا (أو أي جزء منها).
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

The resolution court for any disagreements or misunderstanding that should arise during the course of this contract shall be ‘Qasr Al Adel Court’ – Abdali, Amman - Jordan.
